Increased competition among accreditors and lower administrative burdens could lower the cost and improve the quality of higher education for millions of American students.At the urging of President Donald J. Trump, the Department of Education invited comment on a proposed rule that seeks to “reenvision America’s postsecondary quality assurance system” by simplifying the process of recognizing new accreditors.In a comment filed on Monday, the directors of the Office of Policy Planning and Bureau of Competition applauded the Department’s initiative. Drawing on the Commission’s decades of experience in evaluating accreditation and occupational licensing schemes, the comment concludes that accreditation monopolies drive up tuition costs, limit consumer choice and stifle innovation.As the comment explained, incumbent accreditation authorities often have an incentive to impose rigid requirements and oppose more innovative, flexible standards because university interests exercise outsized influence over the process. For instance, 21 of 27 commissioners on the Middle States Commission on Higher Education are university administrators or faculty. Such individuals have strong incentives to adopt policies that prevent new, lower-cost education options that could reduce tuition and the demand for incumbent universities. Accreditation standards that cement the expensive status quo contribute to their job security and keep wages high, while raising tuition costs.The situation for accreditors of specific professional programs is often worse. Like institutional accreditors, many programmatic accreditors are influenced by higher education interests. These programmatic accreditors are also often guided by incumbent members of the profession with incentives to raise educational costs and create barriers for other lower-cost alternatives to enter the profession and become their competitors.The American Bar Association is a cautionary tale of the competitive harms that result from allowing incumbent professionals and higher education interests to dictate accreditation requirements. The ABA has a long history of using its law school accreditation monopoly to impose excessive costs and controversial ideological mandates. Commission staff have lauded recent initiatives by the Supreme Courts in Ohio, Florida, Texas, Tennessee and other states to reduce their reliance on ABA accreditation. The current comment commends the Department of Education’s push to encourage new accreditors to emerge and compete through accreditation standards that focus on delivering high-quality academic programs at a reasonable price. The Commission vote authorizing the filing of the comment was 2-0. The Federal Trade Commission works to promote competition and to protect and educate consumers. Others struggle to determine appropriate fairness thresholds (including what industry benchmarks should look like) and assess whether they are adequate. Effective oversight of AI in finance is more about better supervision than new regulation While existing requirements still apply and supervised entities are expected to adapt their risk-management frameworks to AI-specific matters, some jurisdictions could benefit from guidance and clarification on how these existing regulatory requirements apply to advanced AI models. In some instances, guidance might clarify ambiguities in interpretation and implementation, for example, in model risk management frameworks, especially regarding issues such as model validation, testing and monitoring, as well as regulatory requirements, such as governance. Rather than imposing rigid, overly prescriptive requirements that could hinder AI adoption, providing interpretative guidance and practical clarifications on applying existing risk-management and governance frameworks in AI contexts may be preferable, where necessary. From static compliance to dynamic understanding Closer engagement between supervisors and industry stakeholders, beyond standard supervisory activities, could foster mutual understanding. Such engagement can yield significant benefits for supervised entities by helping to clarify ambiguity, while also improving authorities’ understanding of the challenges they face in their supervisory efforts. One way financial supervisors can engage with the industry is through AI-specific testing, which can provide confidence and clarity, encouraging innovation while protecting markets, their participants and stability. Initiatives such as the UK’s Financial Conduct Authority (FCA) AI Live Testing programme could help promote constructive dialogue between firms developing or using AI and regulatory agencies, encouraging mutual understanding and learning. Novel approaches to AI supervision: the FCA’s AI Live Testing The FCA’s AI Live Testing programme allows financial services firms to work directly with its regulatory and technical teams when deploying AI systems in controlled live market environments. The programme focuses on how an AI model interacts with its environment. It is not a simulated lab environment, but rather aims to understand the behaviour of deployed AI systems, taking relevant rules and regulations into account. The objective is to support safe, responsible AI adoption without creating new AI‑specific rules, while giving firms regulatory confidence and helping the FCA understand how AI affects UK markets and consumers. How AI Live Testing works: From discovery to live testing The AI Live Testing programme comprises two phases: one for discovery and one for live testing. The programme is designed to be proportionate, with a strong emphasis on in‑person engagement, structured workshops and iterative feedback. The discovery phase is intended to build a clear understanding of the AI system used by a given firm, including its testing and monitoring approach, governance arrangements, controls and key areas of potential risk. Through a series of continued engagement (including in-person workshops) and voluntary evidence‑gathering, the AI Live Testing team assesses: AI system architecture and design Model development and performance Data integrity and pipeline management AI robustness and reliability Explainability and transparency Monitoring, logging and version control Security and technical resilience The live testing phase includes a practical assessment of the firm’s testing and monitoring approaches. Building on the discovery phase, it uses structured workshops and feedback sessions to explore: How to test the AI use case most effectively What evidence is required to demonstrate that an AI system is safe and responsible, including delivering the right outcomes for consumers and markets How testing can demonstrate alignment with FCA regulations and requirements It should be noted that the FCA does not test the AI system on the firm’s behalf. Firms are responsible for testing, pilots and evidence generation, including demonstrating that a given AI system is safe and responsible. AI Live Testing’s role is to analyse the approach taken by firms, review evidence and identify areas where risk management, governance or the interpretation of policies and test results may be unclear or require adjustment to secure the best outcomes for consumers and markets. This ensures that responsibility for the technology, including risk identification and mitigation, remains with the firm. Observed benefits of FCA’s AI Live Testing The aim of AI Live Testing is to help firms design, deploy and monitor safe and responsible AI, not to provide regulatory approval, audit or sign-off. To achieve this, it uses the following approaches: AI flaws are always understood in the context of the firm’s AI use case that is within the scope of AI Live Testing. This avoids an esoteric or overly technical view of harms, keeping the focus on real-world consumer impact. The programme is designed to encourage two-way learning between the FCA and participating firms through feedback loops at all key stages of discovery and testing. It is intended to be exploratory rather than supervisory, focused on insights rather than regulatory judgements, approvals, AI audits or endorsements. No “hands-on” testing: The FCA does not test the system for the firm. It analyses firms’ testing, monitoring and piloting approaches and provides feedback on potential gaps in the firm-level testing regime. AI Live Testing helps build an evidence-based understanding of what works in safe and responsible AI deployment, especially where ambiguities exist, and what may need to change in testing, governance, risk management and continuous improvement Issues brought to the surface by advances in AI innovation To date, AI Live Testing has identified two critical challenges: The first issue is ensuring that AI governance keeps pace with increased complexity as a result of the pace of technological innovation combined with the pace of adoption and deployment of these more advanced AI systems. In practice, this means that effective policies and frameworks are key in designing and deploying safe and responsible AI. This also requires confidence in testing, risk mitigation strategies and the ability of individual firms to monitor. The second issue concerns agentic AI systems. They have multiple possible execution paths, but all relevant eventualities cannot be tested prior to deployment. This presents a fundamental challenge in pre-deployment testing because, by definition, this process is insufficient. Often, the response is to fall back on human control. However, this is a limited means of effectively verifying all the potential actions of an AI model. These developments raise further questions: What do they mean for the overall effectiveness of AI system governance, including the role of human oversight? Where can regulatory requirements on governance, accountability, and systems and controls make a positive difference? And how can regulatory requirements adapt over time to stay relevant and deliver the right outcomes for consumers and markets? Flexible, agile and adaptive AI supervision Maintaining a flexible, agile, and adaptive stance towards supervision is one way financial supervisors can keep pace with technological advances, such as agentic AI. Novel methodologies and techniques could enrich the supervisory toolkit and help to ensure beneficial innovation, stability and trust. They also provide an opportunity for supervisors to ask the right questions of firms in a timely manner, based on insights from these toolkits. Public-private dialogue and proactive engagement between supervisors and regulated entities should support the adoption of new supervisory methods and tools. This collaboration will serve as the foundation for deploying safe and responsible AI in financial markets. At the same time, it enables institutional capacity building, which is key to more effective monitoring of AI activity. By remaining open to enriching and adapting frameworks to reflect the realities and specific characteristics of AI innovation, financial supervisors can foster responsible AI innovation in finance while mitigating associated risks. Shachee Doshi, Michael George September 1, 2026 How AI reshapes work and the economy in the future will be decided by choices that institutions, employers, and policymakers are making now. Ensuring those choices lead to broadly shared prosperity has been central to PAI’s work for years. In July, we wrote that uncertainty over AI’s pace is precisely the reason to plan for more than one future at once. So on July 29 and 30, together with the Windfall Trust, we brought 46 leaders from frontier AI labs, organized labor, civil society, and international organizations to Washington, D.C. to map two very different AI future scenarios and work backward to the actions worth taking in 2026 regardless of which one arrives. Clearer areas of support that emerged ranged from using taxation and public procurement as a lever to share in AIs wealth and institute worker-centric policies to expanding access to open-source AI models trained on local data. We also saw sharp and productive disagreements about financing, each scenario’s likelihood, and whether our collective ambition matched the scale of what may be coming. Those discussions are captured in the full readout, linked here, as well as summarized below. The workshop was held under the Chatham House Rule, so no views are directly attributed to any individual. The workshop is part of PAI’s longstanding AI, Labor, and the Economy program and builds on its multistakeholder Guidelines for Shared Prosperity used as a north star by the U.S. Department of Labor in 2024. It also reflects months of research and consultations to develop the material that workshop participants used as a starting point. VIEW THE READOUT Who was in the room The workshop brought together PAI’s Labor and Economy Steering Committee alongside invited guests. Roughly a third of participants were affiliated with industry, including frontier AI labs, while the rest were affiliated with labor unions or civil society organizations, along with several guests affiliated with multilateral and development institutions. The people building these systems and the people representing or advocating for the workers most affected by them rarely sit at the same table. Any recommendations strong enough to help us thrive in multiple futures must be built by both. Two potential futures, one key question We asked participants to work through two different scenarios of what 2030 could look like, drawing in part on the OECD’s modeling of AI capability trajectories. In the “Slow” future, AI keeps getting better, but the disruption is gradual. You see it in people working fewer hours than they’d like or in earnings volatility. In the “Fast” future, AI improves faster than our current systems can keep up with, and jobs disappear faster than new ones are created. Neither scenario is a prediction. They’re both tools to pressure-test one question: what should we start doing now that would hold up under either future state? Where support was stronger Discussions ran on two parallel tracks, one focused on the United States and one on global impacts, since the pressures AI puts on labor markets, and the tools available to respond, differ across contexts. Within each track, participants worked in small groups from a starter list of potential recommendations, refined and added to them in response to the scenarios, and then indicated which proposals they found most promising through structured voting. The results are a snapshot of where support began building among participants, not a set of final recommendations. Each will be tested and refined through further consultations in the months ahead. In the U.S.-focused discussions, recommendations drawing more support included: Taxing AI-generated wealth through capital gains taxes and corporate taxes, though participants did not align on a single mechanism. Increasing the number of workers represented by labor unions, with participants discussing actions such as federal legislative reform, employer neutrality agreements, or state-level experiments in sectoral bargaining. Building a path to universal government services not linked to employment by expanding existing programs such as Medicare and Social Security, in case there was not enough time to stand up new programs in the ‘Fast’ scenario. Reforming unemployment insurance to expand eligibility and generosity, with a lively discussion of why needed reforms have not yet happened. Dramatically expanding training through trusted, existing institutions such as community colleges and registered apprenticeships. In global discussions, recommendations drawing more support included: Expanding data and model access through open-source models trained on local data and in local languages. Building AI into public procurement standards, with requirements for impact assessments and worker protections. Embedding worker voice in decisions about how AI is developed and deployed. Building global data frameworks to track how AI is affecting labor on the ground. More details are available in the full workshop readout here. Where viewpoints diverged Some of the most productive moments of the workshop came not just when ideas converged, but when participants saw the challenges differently. Some groups proposed trigger points that would automatically activate responses like expanded unemployment insurance, while others countered that anticipatory policy has historically only been built after a crisis forces the issue. Participants agreed on the need to capture AI-generated wealth but not on how, with global discussions especially wary of loan-based financing for countries already carrying heavy debt. U.S. participants generally prioritized training under both scenarios, while global participants were more likely to view it as most relevant in a “Slow” future, leaning more toward public investment and social protection in a “Fast” one. Views also varied on how evolving AI market structure, whether concentrated among a few providers or more open and competitive, would shape recommendations, and on what openness means for access, sovereignty, and safety. Perhaps most striking is that many participants felt uneasy that the solutions discussed may not measure up to the disruption the “Fast” scenario would bring. That discomfort is itself a finding, and one we intend to keep pressure-testing. Some ideas met resistance. In U.S. discussions, some participants pushed back on proposals for the government to take ownership stakes in leading AI companies as a way of sharing in the wealth they generate. In global discussions, the strongest pushback came on proposals to pause AI agents already in use so their effects could be reviewed. Participants argued it makes more sense to address risks before these systems are deployed, through design choices and regulation, than to try to claw them back afterward. What comes next A Scenarios Report in Fall 2026, developed by the Windfall Trust in partnership with PAI, will refine and expand on the two futures participants worked with. A Recommendations Report, developed by PAI in partnership with the Windfall Trust, will further develop the most promising proposals, informed by additional consultations in the months ahead. This work builds on what 10 years of convening across sectors has taught us. The most durable answers come from bringing people with different perspectives into the same room and leaving with something more useful than any of them might produce alone.
